Bolivia, Evo and the TIPNIS national park

The government of Evo Morales wants to make a road in the TIPNIS (Indigenous Territory and National Park Isiboro Secure), and has just approved a law to make a referendum there to let the people vote about it, so the people living there will decide whether there will be the road or not.

This will happen despite another law signed also by Morales that states that the road will not cross the TIPNIS area. This law was approved when the march of the indigenous arrived La Paz walking after one and a half month trip; in this march  they had to suffer bad treatment from the police sent there, who arrested them, separted parents from their children, hit them , ration of water and food, etc.

Very different was the treatment received by the coca growers (that live beside the TIPNIS) who ask this road to be done in the TIPNIS, as they were received in the palace of government by the president Evo Morales with honors and many attentions.

It seems that the coca growers will participate in the referendum that will be done there, so the road in the Indigenous Territory and National Park Isiboro Secure (TIPNIS)  will be done anyway, as they are many and this will happen also despite they don't figure as dwellers of those towns in the official records.

Besides by the Supreme Decree 676 of October 2010 Morales establishes the Isiboro Secure as a zone to make explorations of gas even though the TIPNIS couldn't be disposed like that as it is an indigenous territory and a National Park.
those explorations would affect the rivers Isiboro, Ichoa and Secure, which are now the principal water source of the Mamore river. The extractive activity could affect all the circuit that begins in the lands of the TIPNIS.


But what are the other details of this project ?
- The government went over budget by millions.
- The referendum about the project should have been done before the beginning of the project as it is an Indigenous Territory.
- There are like 300 different species of animals including bears, tigers, dolphins, fish, pigs, monkey, etc.
- In recent years the director of the against the drugs, colonel Oscar Nina, informed they destroyed 20 factories of cocaine around the park Isiboro Secure and at lest there are 700 coca leaves growers are staying in the TIPNIS, which is property of the yuracarés (an indigenous group).


Here is the complete project approved by Evo Morale which has been denied by the referendum he approved:

Proyecto de Ley de Declaratoria del TIPNIS como Patrimonio sociocultural y natural, y zona de preservación ecológica “intangible” libre de carreteras, en el marco de los artículos 30, 385, 394, y 403 de la CPE, las Leyes 1257, 3760 y 1333, y otras normas vigentes.

Ley de Declaratoria de Protección del Territorio Indígena y Parque Nacional Isiboro Sécure TIPNIS
Proyecto de Ley de Declaratoria del TIPNIS como Patrimonio sociocultural y natural, zona de preservación ecológica “intangible” y libre de carreteras, en el marco de los artículos 30, 385, 394, y 403 de la CPE, Leyes 1257, 3760 y 1333, y otras normas vigentes.
Artículo 1.- (Declaratoria de Patrimonio del TIPNIS) I.-  Se declara el Territorio Indígena y Parque Nacional Isiboro Sécure (TIPNIS) patrimonio sociocultural y natural, zona de preservación ecológica y reproducción histórica y hábitat de los pueblos indígenas tsimane, mojeño-trinitario y yuracaré, cuya protección y conservación son de interés primordial del Estado Plurinacional de Bolivia.
II. En el marco de los artículos 30, 385, 394, y 403 de la CPE y otras normas vigentes, se ratifica el TIPNIS como Territorio Indígena de los pueblos tsimane, yuracaré y mojeño trinitario, de carácter indivisible, imprescriptible, inembargable, inalienable e irreversible, y como área protegida de interés nacional.
III. Adicionalmente se declara al Territorio Indígena Parque nacional Isiboro Securé como zona intangible.
IV. En el marco del artículo 403 de la CPE, se reconoce el derecho de los pueblos indígenas a la defensa de su territorio, de acuerdo a usos y costumbres y sus instituciones jurídicas dentro de su jurisdicción, por lo que no serán pasibles a ser procesados por dichas acciones.
Artículo 2. (Carreteras por el TIPNIS). Se dispone que la carretera Villa Tunari San Ignacio de Moxos, como cualquier otra, no atravesará el Territorio Indígena y Parque Nacional Isiboro Secure.
Artículo 3.- (Garantía). En ningún caso se adoptarán normas o ejecutarán actividades, obras, proyectos, o programas de desarrollo, extractivos, megaproyectos y de infraestructura u otros, que vulneren los derechos de los pueblos indígenas, del medio ambiente y los derechos de la Madre Tierra, de acuerdo a la Constitución Política del Estado, Ley 1257, Ley 3760 y Ley 1333.
Artículo 4.- (Protección). Dado el carácter intangible del Territorio Indígena y Parque Nacional Isiboro Secure – TIPNIS se deberán adoptar las medidas legales correspondientes que permitan revertir, anular o dejar sin efecto los actos que contravengan a esta naturaleza jurídica.
Artículo 5. (Prohibición de asentamientos humanos ilegales en el Territorio Indígena y Parque Nacional Isiboro Secure – TIPNIS). De conformidad al Artículo Primero de la presente ley al ser declarado territorio intangible, los asentamientos y ocupaciones de hecho promovidas o protagonizadas por personas ajenas a los titulares del Territorio Indígena y Parque Nacional Isiboro Secure – TIPNIS, son ilegales conforme a la Disposición Transitoria Octava de la Ley 3545 de 2006  y serán pasibles de desalojo con intervención de la fuerza pública si fuera necesario a requerimiento de autoridad administrativa o judicial competente de oficio, con o sin denuncia escrita o verbal de los titulares. Asimismo, las autoridades competentes en materia de tierras y el Ministerio público iniciarán las acciones legales correspondientes por las perturbaciones al derecho posesorio y derecho de propiedad, de oficio o a petición de parte, así como se constituirán en parte civil en la comisión de delitos conforme las condicionantes  del capítulo VII del Código Penal.
Artículo 6. (Paralización de obras). Se determina la paralización inmediata de obras en ejecución de la carretera Villa Tunari San Ignacio de Moxos y se  determina la reparación y restauración al estado original.
Artículo 7.- (Abrogación de normas contrarias a la presente ley).  Se abrogan y/o derogan todas las normas contrarias a la presente ley. Asimismo se establece la nulidad de todos los actos administrativos y contractuales que contravengan a esta naturaleza jurídica.

Bolivia in war for Evo

Bolivia in war for Evo: Doctors conflict and the TIPNIS and us


This month of April-May has been very conflicted.


Evo approved a law to force doctors to work for 8 hours and the doctors don't agree on that.



Since that some changes have happened:
- The doctors are not working but the ones for emergencies...
- The students of medicine are in the streets fighting with the police.
- Patients can't receive attention and they have to wait and get worse.
- The whole month there is the smell of the pepper gas in the streets of the downtown.
- If you happen to be near a fight between the police and the students of medicine then you will have to cry, desperate and suffer all this without anywhere to complain...
- There are no announcements that the government will abrogate their law.... and we all suffered this alreadly for a month.

And I ask ? Why can't we enjoy of some time of tranquility here in La Paz ? Why are people always forced to go to the streets and fight for their rights ? And here I have to say that I am not agains that the doctors would work for 8 hours but if they don't want then there is no point to force them to do it!
But it's not that simple... the fact is that: they usually work (after their working hours for the government in public hospitals) in other jobs as doctors too, sometimes they do it in their own offices and sometimes in other hospitals, but the point is that they do that do earn more money. And if the government would force the 8 hours of work then the doctors would be forced to work 2 hours more without any increase in their salaries, which is not correct too.

Here I am impressed with the government because they don't want to facilitate the dialogue with this sector and they just send groups of policemen that throw lots of pepper gas and accompanied with their Neptuno car that throws water to the students.
Here the images are of a right wing-totalitarian government and they don't correspond to a government of a left wing, as many supposed Evo Morales could be.

Evo Morales approves, decides, and make all the decisions of all his government (included what all the ministries of all the departments will do in their investments of important purchases) in his palace of government and makes sure all his decisions will happen the way he already decided.
What is this but not tyranny ?

A few days ago the coca growers took the streets of Cochabamba to make a demonstration to support Evo Morales... and they are the only beneficiaries of the "proceso de cambio" or in English "process of change"... but what change ?
Isn't it real that the government is forcing the doctors to do this ? And even Evo said that if the doctors don't want to work for 8 hours they would bring Cuban doctors to do their jobs.. What is happening with Evo Morales ? He is not the king of Bolivia, he has to realize it, but maybe he is surrounded by people like Alvaro Garcia Linera (a very smart and kind of maquiavelic person) that could be responsible of the violence the government is lately using.

As Evo Morales didn't respect the agreement he signed with the indigenous of the TIPNIS (Territorio indígena y parque nacional Isiboro Secure) and he approved another law to confirm the construction of the road crossing the TIPNIS, then the indigenous of the TIPNIS are coming again to La Paz to stop it.
Which makes me remember that a spokesman of the government said to the doctors something like "ok, the law of the 8 hours won't have effect but stop your demonstrations" but the doctors said they didn't believe the government anymore as they cheated on the indigenous of the TIPNIS not respecting the agreement the president Evo Morales signed with them.

And they are right because if a president doesn't have a word and goes back on his own agreements then all the faith people could have on the government is gone.

Besides, it's well known that the project of the road should have consulted before the project had began and the government should have put the construction of the TIPNIS road out to tender instead to give it directly to the ABC Brazilian company without any tender.

The indigenous of the TIPNIS are coming again to La Paz and they didn't receive the support of some communities loyal to the MAS (politician party of the government). It is also well known that many indigenous of different communities have received bribes of the government in the form of cars and other economic benefits to not support this march to protect the TIPNIS.

Even I voted for Evo in the elections I regret now it and many I know does the same, we all regret it.
What is this government doing ? What really ? I can say that their measures against corruption and in favor the indigenous of the country are not really working... they are just part of a campaign to create a "good image of the government", the constitutions they approved have improved the conditions of Bolivians ?
No.


This president full of arrogance, full of purchases without any sense, full of contracts without any put to tender, full of simple things like playing soccer instead of try to solve the problems of a Third world country, full of discourses on how to protect the "Mother Earth" and how the situation of the indigenous of the country have improved... this president now is lonely with his discourses, he is nothing but his words...

He has to learn: to listen to people, to put the projects to tender, to not buy land nor to have other millions spent just to buy things to China, no to do whatever he thinks just because he can... he has to learn to create peace here too (and not approve reforms like the ones of the doctors), and to cancel all his millionaire spends.

And talking again about the doctors... can you imagine how a person is if he couldn't receive the medical service he needs ? Now imagine that in thousands... that is the situation here... and it's about time that Evo Morales would be less stubborn and that he wouldn't say "the road of the TIPNIS will be constructed no matter anything"... and here I think that it's incredible that we had chosen him as our president, do people always have to chose their tyranny for the next years? I guess that in Bolivia the governments should be approved just with mandates, in that way all the governments would be allowed to make a few things but just them... and we all would be better!
Evo Morales buys useless millionaire things, approve laws that creates conflicts, doesn't put projects to tender, wants to force projects even is they are against the laws (and laws the only thing that preserves peace inside a country and they can change but with the interest to benefit the people as a whole but not to make happy the president .. as he once implied...), doesn't respect indigenous, benefits coca growers (as he is the president of the coca growers of the country...) as a kind of special group that must be benefited and satisfied in first place (and over the whole country interest)

And you know that if there is going to be a consult in the TIPNIS  (now that the whole road is already constructed and the only the part left to be done is the part that would cross the TIPNIS ) also the coca growers will vote there because they live beside the TIPNIS (and many of them are living also inside the TIPNIS in these last 4? years)... what kind of fair consult can we expect from it ?
Besides, I really voted for Evo, and I am ashamed of it... but there are stories of friends that say that their votes were already done when they wanted to vote the last time... and if this is real.. then we can expect nothing from that consult and from any other election in Bolivia in the following years.

Evo should call another election, he should leave and even in Bolivia that we don't have other big politician parties maybe if the indigenous of the TIPNIS would participate in the election they would have a lot of support of the middle class that believed in Evo before.

Bolivia y Evo Morales

Evo Morales no sabe lo que es ser presidente de Bolivia: Quiere un camino que cruza el parque nacional del Territorio Indígena y Parque Nacional Isiboro Secure (TIPNIS) aunque no haya habido una consulta previa a los lugareños, aunque el proyecto tenga un sobreprecio descomunal, aunque no haya habido licitación para el proyecto, aunque ya haya una ley que proteja al TIPNIS y ya la haya firmado él mismo.


No ha valido de nada el esfuerzo de los campesinos que tardaron en llegar más de un mes a La Paz porque Evo Morales tiene preferencias por los cocaleros que quieren y necesitan más campos de cultivo de coca en la zona.
Evo detiene, ejerce violencia mediante los policías, maltrata, separa a padres de sus hijos , en el caso de los defensores del TIPNIS pero, felicita y rinde honores a los cocaleros que han llegado reclamando la carretera (de un territorio donde no viven ellos, recien instalados para plantar coca, claro)... que diferencia Señor Presidente!  Que diferencia! Y que bajo ha caído y que mal nos hace sentir a los que en algún momento votamos por usted.

Y es tan terrible saber que los partidos de derecha en Bolivia hayan tenido la razón: El cocalero sí es más presidente de los cocaleros que presidente de Bolivia, y sí es imparable ... es una traición a su pueblo mismo, a la gente pobre que ve como los cocaleros y narcotraficantes hacen su agosto mientras la gente que tiene valores y juega con las reglas y respeta las leyes va solamente desmejorando su situación.
                                                               
Cómo podría explicar Evo el sobreprecio de la carretera ? Será que todos los gobernantes de Bolivia tienen que ser tiranos luego de algún tiempo ? Será que creen que gobernar es desnutrir al pueblo, menospreciarlo y violarlo ?

Evo Morales dice con total cinismo (que, la verdad, no tendría si hubiera terminado el colegio o ido a la universidad o hubiera leído más libros o hubiera tenido algo de moral... un Morales sin moral, digamos) que si "algo es ilegal los abogados están para arreglarlo..." mostrando un total desprecio de todo, un total desconocimiento del estado de derecho, de saber que el respeto a las leyes es necesario para preservar la paz en una sociedad. Tendrían que llevar cursos de derecho los aspirantes a presidentes de Bolivia porque tan cínico desconocimiento de los valores sólo puede hacerlo un loco, o un ignorante o un desenfrenado con poder de sobra ... como debe ser el caso.

Evo Morales no tiene ataduras más que con los cocaleros, la China, las transnacionales brasileñas como ABC de carreteras (porque aunque se cambien de nombre siguen ofreciendo proyectos con sobreprecio al gobierno y el gobierno sigue aceptando desde hace décadas...) , entonces dime dónde está el cambio con Evo ? No ha habido ningún cambio: Todo es maquillaje.

Su Constitución también fue un cambio de maquillaje porque acaso la situación de los indígenas ha mejorado ? Acaso la corrupción no sigue igual o peor ? Acaso no son los indígenas ahora los corruptos o más corruptos que antes ? Y quién, quién va a parar el narcotráfico cuando Evo se vaya ? Quién echará a las redes de narcotráfico que se han infiltrado en Bolivia ? Acaso o si quiera se invierte el dinero "excedente" del país en empresas rentables ? No! Ni siquiera eso, se está maltratando al país, endeudándonos con Brasil y China por sus negociados no más.

Y la gente de Bolivia fregada como siempre. Dime Evo Morales, tú, si lees esto, tú que te crees Dios pero que eres como todos mortal no más... Qué se siente fallar a tu pueblo ?
Te has emborrachado de poder para no acordarte que la gente creía en tí ? Y don Garcia Linera , una total decepción también. De qué sirve el haber leído cientos de libros si no se los aplica para el bien ? De qué sirve tener cerebro si no sirve de nada ? Ni si quiera para dar una buena idea, ni para crear algo de bienestar...

El presidente y el vicepresidente no merecen estar allá, han fallado como todos.


Porque ese aparapita que va a vivir y morir cargando
 bultos, ese niño que lustra las botas, y el señora de la tienda tiene más valores que esa gente que dirige al país... La gente que se mete en política es de lo peor y tal vez por eso debían postularse personas pero no partidos al gobierno... la gente que se vende o que no puede objetar decisiones por ser parte de un partido no tiene independencia de acción y responde a su partido y no a la gente que votó por ellos.
Y así la democracia no funciona, no funciona  Bolivia, y el país sigue mal esté la derecha o la supuesta izquierda con el MAS, todos se venden al final.



Y la COB vendida dice que no apoyará la defensa del TIPNIS, habrá que preguntarles cuanto les pagaron... y si les pagaron bien... porque la verdad siempre se sabe cuando la saben muchos.

Ojala que el presidente Evo Morales y García Linera (quienes olvidaron porque lucharon o que fueron pobres o que tenían valores) renunciaran y hubiera elecciones otra vez, pero ya no es hora de soñar , estamos viviendo nuestra pesadilla que es a su vez el sueño dorado de Morales, Linera, Brasil y China.

Y habrá que volver a empezar de cero otra vez porque el MAS no sirve más que para los cocaleros, los narcos, las transnacionales y la gente de su partido que sigue ciegamente lo que hace el tirano Evo Morales por ganar un sueldo ... ese sueldito que cae bien a todos y que compra conciencias... no ?
Y tanto la gente de base había luchado para esto! Que vergüenza par de sinvergüenzas!! Partido de sinvergüenzas!

Donde está la gente de base de Bolivia que opina de los proyectos del gobierno ? Antes los movimientos sociales se metían y discutían los proyectos .. pero ahora con haber comprado a sus dirigente sólo se sigue órdenes.. porque a los funcionarios el MAS no les paga para pensar , sino solo para obedecer ..



Y este es el país que tenemos: Un verdadero lamento boliviano.

Y usted que opina de la carretera del TIPNIS y del gobierno de Evo Morales hasta ahora ?
