The government of Evo Morales wants to make a road in the TIPNIS (Indigenous Territory and National Park Isiboro Secure), and has just approved a law to make a referendum there to let the people vote about it, so the people living there will decide whether there will be the road or not.
This will happen despite another law signed also by Morales that states that the road will not cross the TIPNIS area. This law was approved when the march of the indigenous arrived La Paz walking after one and a half month trip; in this march they had to suffer bad treatment from the police sent there, who arrested them, separted parents from their children, hit them , ration of water and food, etc.
Very different was the treatment received by the coca growers (that live beside the TIPNIS) who ask this road to be done in the TIPNIS, as they were received in the palace of government by the president Evo Morales with honors and many attentions.
It seems that the coca growers will participate in the referendum that will be done there, so the road in the Indigenous Territory and National Park Isiboro Secure (TIPNIS) will be done anyway, as they are many and this will happen also despite they don't figure as dwellers of those towns in the official records.
Besides by the Supreme Decree 676 of October 2010 Morales establishes the Isiboro Secure as a zone to make explorations of gas even though the TIPNIS couldn't be disposed like that as it is an indigenous territory and a National Park.
those explorations would affect the rivers Isiboro, Ichoa and Secure, which are now the principal water source of the Mamore river. The extractive activity could affect all the circuit that begins in the lands of the TIPNIS.
But what are the other details of this project ?
- The government went over budget by millions.
- The referendum about the project should have been done before the beginning of the project as it is an Indigenous Territory.
- There are like 300 different species of animals including bears, tigers, dolphins, fish, pigs, monkey, etc.
- In recent years the director of the against the drugs, colonel Oscar Nina, informed they destroyed 20 factories of cocaine around the park Isiboro Secure and at lest there are 700 coca leaves growers are staying in the TIPNIS, which is property of the yuracarés (an indigenous group).
Here is the complete project approved by Evo Morale which has been denied by the referendum he approved:

Ley de Declaratoria de Protección del Territorio Indígena y Parque Nacional Isiboro Sécure TIPNIS
Proyecto de Ley de Declaratoria del TIPNIS como Patrimonio sociocultural y natural, zona de preservación ecológica “intangible” y libre de carreteras, en el marco de los artículos 30, 385, 394, y 403 de la CPE, Leyes 1257, 3760 y 1333, y otras normas vigentes.
Artículo 1.- (Declaratoria de Patrimonio del TIPNIS) I.- Se declara el Territorio Indígena y Parque Nacional Isiboro Sécure (TIPNIS) patrimonio sociocultural y natural, zona de preservación ecológica y reproducción histórica y hábitat de los pueblos indígenas tsimane, mojeño-trinitario y yuracaré, cuya protección y conservación son de interés primordial del Estado Plurinacional de Bolivia.
II. En el marco de los artículos 30, 385, 394, y 403 de la CPE y otras normas vigentes, se ratifica el TIPNIS como Territorio Indígena de los pueblos tsimane, yuracaré y mojeño trinitario, de carácter indivisible, imprescriptible, inembargable, inalienable e irreversible, y como área protegida de interés nacional.
III. Adicionalmente se declara al Territorio Indígena Parque nacional Isiboro Securé como zona intangible.
IV. En el marco del artículo 403 de la CPE, se reconoce el derecho de los pueblos indígenas a la defensa de su territorio, de acuerdo a usos y costumbres y sus instituciones jurídicas dentro de su jurisdicción, por lo que no serán pasibles a ser procesados por dichas acciones.
Artículo 2. (Carreteras por el TIPNIS). Se dispone que la carretera Villa Tunari San Ignacio de Moxos, como cualquier otra, no atravesará el Territorio Indígena y Parque Nacional Isiboro Secure.
Artículo 3.- (Garantía). En ningún caso se adoptarán normas o ejecutarán actividades, obras, proyectos, o programas de desarrollo, extractivos, megaproyectos y de infraestructura u otros, que vulneren los derechos de los pueblos indígenas, del medio ambiente y los derechos de la Madre Tierra, de acuerdo a la Constitución Política del Estado, Ley 1257, Ley 3760 y Ley 1333.
Artículo 4.- (Protección). Dado el carácter intangible del Territorio Indígena y Parque Nacional Isiboro Secure – TIPNIS se deberán adoptar las medidas legales correspondientes que permitan revertir, anular o dejar sin efecto los actos que contravengan a esta naturaleza jurídica.
Artículo 5. (Prohibición de asentamientos humanos ilegales en el Territorio Indígena y Parque Nacional Isiboro Secure – TIPNIS). De conformidad al Artículo Primero de la presente ley al ser declarado territorio intangible, los asentamientos y ocupaciones de hecho promovidas o protagonizadas por personas ajenas a los titulares del Territorio Indígena y Parque Nacional Isiboro Secure – TIPNIS, son ilegales conforme a la Disposición Transitoria Octava de la Ley 3545 de 2006 y serán pasibles de desalojo con intervención de la fuerza pública si fuera necesario a requerimiento de autoridad administrativa o judicial competente de oficio, con o sin denuncia escrita o verbal de los titulares. Asimismo, las autoridades competentes en materia de tierras y el Ministerio público iniciarán las acciones legales correspondientes por las perturbaciones al derecho posesorio y derecho de propiedad, de oficio o a petición de parte, así como se constituirán en parte civil en la comisión de delitos conforme las condicionantes del capítulo VII del Código Penal.
Artículo 6. (Paralización de obras). Se determina la paralización inmediata de obras en ejecución de la carretera Villa Tunari San Ignacio de Moxos y se determina la reparación y restauración al estado original.
Artículo 7.- (Abrogación de normas contrarias a la presente ley). Se abrogan y/o derogan todas las normas contrarias a la presente ley. Asimismo se establece la nulidad de todos los actos administrativos y contractuales que contravengan a esta naturaleza jurídica.
